Orissa High Court Says Section 498A is Often Misused Against In-Laws
The Orissa High Court has observed that Section 498A of the Indian Penal Code (IPC), which deals with cruelty to a wife, is frequently misused to pressurize the husband’s family. The court quashed a dowry harassment case filed against a woman by her brother’s wife, citing lack of evidence.

Justice G Satapathy, who delivered the ruling, pointed out that many false cases are filed against parents-in-law, siblings, and distant relatives. Often, people who do not even live in the same house as the married couple are accused to create pressure on the husband’s family.
The court further stressed that while genuine cases of dowry harassment do exist, many complaints are filed in the heat of the moment over minor disputes. Therefore, courts must carefully examine each case to distinguish between real and false allegations.

In this case, the petitioner, the husband’s sister, approached the Orissa High Court to quash the criminal proceedings against her. The complaint was filed by her brother’s wife, who accused her husband and in-laws of mental and physical torture for dowry demands.
The petitioner argued that:
- The allegations against her were completely false.
- She had been married and lived in a separate house with her husband.
- There was no proof of her involvement in any dispute between the couple.
After reviewing the facts, the court ruled in her favor and quashed the case, stating that no offense was made out against her.
