A division bench of Justices V Kameswar Rao and Anoop Kumar Mendiratta was hearing the case of a man whose appointment as a sub-inspector in Delhi Police was put on hold because he was named in a Section 498A FIR. The complaint was filed by his sister-in-law against his brother and the entire family.
Despite clearing all recruitment exams from May 2017 to September 2018, the Commissioner of Police, Delhi withheld his appointment due to the pending case.

The Delhi High Court noted that there is a growing trend of falsely implicating all of a husband’s relatives, even minors, in matrimonial disputes. Many of these cases are later settled out of court, as they are often filed in the heat of the moment over trivial issues.

- Authorities cannot indefinitely delay an applicant’s appointment due to unsubstantiated FIRs.
