Gauhati High Court Convicts Lawyer for Calling Woman Judge ‘Bhasmasur’

The Gauhati High Court recently convicted lawyer Utpal Goswami for his derogatory comments about a woman judge of a subordinate court, comparing her to the mythical demon ‘Bhasmasur’. The conviction was based on a suo motu case handled by Justice Kalyan Rai Surana and Justice Devashis Baruah.

Case Background

Advocate Utpal Goswami made remarks about the judge’s jewelry and demeaned her character. He faced criminal contempt charges under Section 14 of the Contempt of Courts Act, 1971. The court granted him bail on a personal bond of Rs 10,000.

Court’s Observations

The court noted that Goswami’s comments were not only disrespectful but also attacked the judge’s understanding of the law. The bench stated, “Several allegations have been made to demean the judicial officer, even comparing her to Bhasmasur from Purana/Mahabharat.”

Advocate’s Admission and Apology

In his defense affidavit, filed on January 17, Goswami pleaded guilty and acknowledged his mistake. He admitted to having insufficient knowledge of the law and promised not to repeat such behavior. He expressed his unconditional apology, emphasizing that this was his first offense.

Court’s Order

The bench highlighted Goswami’s scathing comments, noting, “The petitioner compared the presiding officer to a model on a ramp, wearing jewelry, and accused her of overpowering advocates with unnecessary case laws without proper hearings.”

Sentencing

The sentencing hearing was scheduled for March 20, 2023, but further updates are yet to be received.
