The Bombay High Court has quashed a rape FIR after the accused and the 25-year-old victim married each other in Raigad. Advocate Ganesh Gupta, representing the accused, highlighted the woman’s affidavit in which she expressed her desire to drop the charges now that they are married.
The woman stated that her relationship with the accused, which began in 2019, was consensual. She explained that the FIR was filed due to a misunderstanding. According to her complaint, she and the accused had known each other since 1999, and he had established a physical and sexual relationship with her on the false promise of marriage. She claimed that he later refused to marry her, leading to the FIR.
The FIR was filed at Tilak Nagar Police Station, Mumbai, on January 2, 2021, accusing the man of offences under Sections 376 (rape), 504 (intentional insult), 506 (criminal intimidation), 376(N) of the Indian Penal Code, and Section 67A of the Information Technology Act. The complaint also alleged that the man had forwarded an obscene video of the woman to her brother and aunt.
However, since the FIR was filed, the couple married and have a six-month-old son. Advocate Nazneen Khatri, representing the man, stated that the couple is happily married and the woman does not wish to pursue the case further.
