Bombay HC Prioritizes Wife’s Transfer Plea, Highlights Women’s Need for Legal Protection
In a significant judgment, the Bombay High Court ruled that women, as the weaker section of society, deserve greater legal protection. The case involved two transfer applications—one by the wife and the other by the husband—concerning petitions for divorce and restitution of conjugal rights.
Case Details
The wife filed a plea to transfer the restitution petition filed by her husband from the Family Court in Pune to the Civil Judge, Senior Division, Thane, where her divorce petition was already pending. On the other hand, the husband sought to transfer the wife’s divorce petition to Pune, where his restitution petition was ongoing.
Legal Analysis
Justice S. M. Modak, presiding over the case, analyzed Section 21A of the Hindu Marriage Act and noted that the provision applies only to petitions seeking certain specified reliefs, such as divorce. Since restitution of conjugal rights is not mentioned under Section 21A, the case had to be evaluated under Section 24 of the Code of Civil Procedure (CPC).
The court observed that, as the applicant was a woman, her inconvenience should be given more priority. It emphasized:
“The law considers women as a weaker section of society and ensures additional protection for them.”
Grounds for Transfer
The wife argued that she faced severe ill-treatment during her cohabitation with her husband and feared for her safety if required to visit Pune. The court acknowledged her concerns, stating that danger to her life at the husband’s location could be a valid ground for transfer.
Court’s Decision
In light of these observations, the Bombay High Court dismissed the husband’s transfer application and approved the wife’s plea, transferring the case to Thane.
