Supreme Court Halts Divorce Proceedings After Wife Requests IVF Cooperation

The Supreme Court has paused the divorce proceedings between an estranged couple following the wife’s request for her husband’s cooperation in the in-vitro fertilisation (IVF) process. The woman needs her husband’s sperm for the IVF treatment.

The 44-year-old woman has asked the court to transfer the divorce case, currently filed in Bhopal by her husband, to Lucknow, where she now lives with her parents. The Supreme Court has agreed to consider this request.

In her petition, the woman explained that the couple married in November 2017. Despite numerous requests, her husband delayed their plans for parenthood, citing his unemployment as a reason. In March this year, after considerable persuasion, her husband agreed to have a child through IVF. They began the necessary medical tests and started treatment under the doctor’s guidance.

However, the woman was shocked when her husband abruptly filed for divorce while the IVF treatment was still ongoing. He cut off all contact with her, leaving her emotionally distressed and blocking her calls.

The woman also claimed that she was forced out of their matrimonial home and is struggling to defend her case in Bhopal while living with her parents in Lucknow. She has requested the Supreme Court to transfer the divorce case to Lucknow for her convenience.

The court has issued a notice to the husband and ordered a stay on further proceedings in the Bhopal family court case. The Supreme Court’s decision also includes a directive for the husband to cooperate with the IVF process, including providing sperm and any other necessary support as advised by the doctors.

The woman’s petition states that her husband had previously requested her to live with her parents temporarily, promising they would start a family once he had stable employment. After securing a job, the man agreed to the IVF process, but his subsequent actions have led to the current legal situation.
