“Supreme Court Emphasizes Discipline in Armed Forces over Adultery Cases”

The Supreme Court reiterated on Thursday the necessity for armed forces to establish disciplinary measures for addressing adultery among their officers, stressing its potential to disrupt their lives significantly.

Justice K M Joseph emphasized the critical role of discipline in uniformed services, highlighting that adultery not only causes emotional pain but also destabilizes families. He underscored the importance of fidelity in maintaining societal integrity, especially within the armed forces.

The bench, comprising Justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy, and C T Ravikumar, was hearing a plea by the Union government seeking clarity on disciplinary actions under the Army Act post a 2018 judgment that struck down penal provisions on adultery.

The court clarified that despite the 2018 judgment decriminalizing adultery under Section 497 of the IPC, disciplinary actions under the Army Act should proceed as necessary to uphold military discipline.
