Refusing Mental Health Treatment Is Cruelty to Spouse: Kerala High Court

The Kerala High Court recently dismissed a woman’s appeal challenging a divorce decree granted to her husband on grounds of cruelty and desertion. The court emphasized that refusing to seek treatment for mental health issues, which disrupts marital harmony, amounts to cruelty.

The bench of Justice A. Muhamed Mustaque and Justice Sophy Thomas observed that the husband had successfully proven that his wife’s behavior caused him significant mental distress. The wife, however, failed to substantiate her claims of being mistreated and forced out of the matrimonial home.

Husband’s Allegations of Mental Cruelty

The husband alleged that his wife exhibited extreme anger and mental health issues since their marriage began. He claimed she repeatedly refused to seek treatment and even threatened his life during their time together.

The couple’s daughters also testified against their mother. They stated that she verbally and physically abused their father and often threatened to harm him or herself. The daughters recounted how their mother left them with their father and grandmother, abandoning her responsibilities.

Court’s Observations on Mental Cruelty

The court highlighted that mental cruelty cannot be strictly defined, as it varies based on circumstances. It noted that under Section 10 of the Indian Divorce Act, applicable to Christians, cruelty must create a reasonable fear of harm or injury in the spouse’s mind, including emotional or psychological harm.

The court ruled that any behavior obstructing a spouse’s personal growth or enjoyment of marital life falls under the scope of cruelty. Given the evidence, the court concluded that the husband had sufficiently proven his case and upheld the divorce decree.

Conclusion

This ruling emphasizes the importance of addressing mental health issues within marriage and recognizes that refusal to seek treatment can severely impact marital relationships.
