In a recent ruling, the Madras High Court has directed a woman to treat her estranged husband with hospitality whenever he visits their child, following the Indian cultural principle of “Atithi Devo Bhava” which means “Guest is God.” This decision was made to ensure a positive environment for the child.
The case involved a petition filed by the father of a 10-year-old girl seeking joint custody and shared parenting. The court granted the father’s request, allowing him to visit the child on Fridays and Saturdays from 6 to 8 p.m. The couple, who are separated, live in different towers of a high-end residential complex in Chennai.
Justice Krishnan Ramaswamy highlighted that influencing a child against the other parent is a form of child abuse. He stated, “Children do not naturally feel hatred; it is an emotion they are taught. Therefore, turning a child against their other parent is considered child abuse. Every child deserves and needs a loving, unthreatened relationship with both parents.”
The judge observed that while separated couples may not need to show love towards each other, basic humanity requires them to be kind in front of their children. He noted several instances where the parent with custody mistreats the visiting parent, creating a hostile environment for the child.
Justice Ramaswamy stressed that in considering the child’s best interests, courts generally allow parents to visit their children even when they are in the custody of the other parent. Unfortunately, these visits often lead to conflicts and mistreatment, affecting the child negatively.
The court instructed the wife to show hospitality to the husband during his visits, such as by offering snacks and dinner. The goal is to create a pleasant atmosphere, so the child can feel happy and enjoy these moments with both parents.
The judge concluded by advising the wife to create a warm and welcoming environment to ensure the child’s well-being during these visits.
