Madhya Pradesh High Court Modifies Controversial Judgment on Rape Convict

The Madhya Pradesh High Court recently revised a controversial statement from its October 18, 2022, judgment, where it had said that a rape convict was “kind enough” to leave the survivor alive.

The original judgment, delivered by a bench of Justices Subodh Abhyankar and Satyendra Kumar Singh, reduced the convict’s life sentence to 20 years of rigorous imprisonment. This statement, which implied kindness in sparing the survivor’s life, sparked widespread criticism.

On October 27, the Court decided to modify the judgment suo motu, removing the contentious observation. It clarified that the use of the word “kind” was an inadvertent mistake. The revised judgment now reads:

“However, considering the fact that he did not cause any other physical injury to the victim, this Court is of the opinion that the life imprisonment can be reduced to 20 years’ rigorous imprisonment.”

The Court emphasized that the convict’s actions were “demonic” and reiterated its reliance on the evidence provided by prosecution witnesses and the medical report, which confirmed the crime beyond reasonable doubt.

The original case involved Ramsingh, who was convicted of raping a girl under the age of 12. While the Court upheld the reduction in sentence from life imprisonment to 20 years, it removed the language that appeared to mitigate the severity of the crime.

The order instructed that the revised paragraph replace the original observation in the judgment and be read in conjunction with the October 18 order.
