MP High Court Says Live-In Relationships Contribute to Rise in Sexual Offences

The Madhya Pradesh High Court recently observed that live-in relationships are contributing to a rise in sexual offences. Justice Subodh Abhyankar of the Indore bench made this remark while rejecting the anticipatory bail plea of a 25-year-old man accused of raping a woman.

Court’s Observation

In an order dated April 12, the court noted a growing number of cases stemming from live-in relationships. Justice Abhyankar remarked, “The bane of live-in relationships is a by-product of Constitutional guarantees under Article 21, which promotes lascivious behavior, leading to an increase in sexual offences.”

Article 21 of the Indian Constitution ensures the right to life and personal liberty, which courts have interpreted to include the right to privacy and dignity. However, the court expressed concern over the misuse of this freedom in live-in relationships, affecting traditional social values.

Case Details

According to the prosecution, the accused had threatened the woman’s family through video messages, claiming he would commit suicide and hold her and her family responsible. These threats ultimately led to the cancellation of the woman’s arranged marriage.

The court emphasized that the rise in offences linked to live-in relationships reflects a shift in societal norms, requiring closer scrutiny.
