In a notable case, a special court for Protection of Children from Sexual Offences (Pocso) Act fined a woman ₹20,000 for falsely accusing her husband of raping her 16-year-old sister. The case, filed in 2019, was dismissed after the court found the allegations baseless.
Court Findings
The special judge, Mahendra Srivastava, reviewed the evidence and found the rape allegations untrue. The minor sister, who was the alleged victim, testified during the trial that her brother-in-law never harmed her.
Case Background
The woman, a resident of Nalluthukuli village near Pollachi, had reported to the Pollachi all-women police station that her husband repeatedly raped her sister, who had been living with them after losing her parents. Based on her complaint, the police arrested the husband under sections 5(l), 5(n), and 6 of the Pocso Act, along with Section 506(i) of the Indian Penal Code.
Court’s Decision
After reviewing all evidence and the sister’s testimony, the court acquitted the husband and fined the woman for filing a false case. This verdict highlights the importance of truthful allegations in serious cases like sexual offenses.
