Husband Cannot Seek Divorce to Avoid Responsibilities, Says MP High Court

The Madhya Pradesh High Court recently dismissed a husband’s appeal for divorce, emphasizing that a man cannot evade his responsibilities as a husband and father by claiming he wishes to dedicate his life to serving his parents.

In the case of Parag Pandit vs. Smt. Sadhana, the husband sought divorce under Section 13 of the Hindu Marriage Act. However, the Family Court rejected his plea, stating that the disputes between the couple were minor and did not amount to cruelty, which is a necessary ground for divorce.

Unhappy with the decision, the husband approached the Madhya Pradesh High Court. The Bench, comprising Justice Vivek Rusia and Justice AN Kesharwani, reiterated that under Hindu law, marriage is a sacred and lifelong bond. The court highlighted that marriage is not just a legal agreement but a holy union with responsibilities that cannot be disregarded.

The court firmly stated that the husband cannot use his wish to serve his parents as a reason to abandon his marital obligations. Consequently, the High Court upheld the Family Court’s ruling and dismissed the husband’s appeal.
