Father Awarded Custody of Children: Delhi Court Prioritizes Their Welfare

In an unusual ruling from October 2021, a Delhi court granted interim custody of two young children to their father. The court emphasized that while the mother has the right to choose her personal life, it cannot come at the expense of her children’s well-being.

The mother left her matrimonial home in October 2020, taking her two children—aged 4.5 years and 18 months—with her. Subsequently, the father sought custody, alleging that the mother’s illicit relationship was negatively impacting their children.

According to the father, the mother had traveled to Goa for three days with her lover, leaving the children in the care of a maid. This incident raised concerns about the children’s welfare and the mother’s ability to provide adequate care.

Principal Judge Anju Bajaj Chandna stated that the mother’s conduct could hinder the children’s balanced and healthy development. She noted, “Children require attention and affection from their parents, which the mother has not been providing.”

The court acknowledged that a parent’s character is not the sole factor in custody decisions but highlighted how parental priorities and actions influence the children’s growth.
