In a landmark judgment on July 15, a woman in Hailakandi, Assam, was sent to judicial custody by the Additional Session Judge for filing a false rape case. She has also been charged under Sections 193 and 195 of the IPC for giving false evidence and making a false declaration before the court.
The woman’s FIR initially claimed that the accused person had “raped her,” leading to a case being registered under Sections 448 and 376 of the IPC. However, the court found that she provided false evidence, and the accused requested proceedings against her. The dispute stemmed from a land issue between the two parties.
The court emphasized the gravity of false rape allegations, stating, “Offence of rape is serious in nature. Whenever such incidents are reported, society demands severe punishment for the wrongdoers. Unfortunately, some false cases are filed, ruining the lives of innocent individuals. Courts are established to deliver justice to those whose rights have been infringed.”
The court further added, “The judicial and police authorities should not be tools of oppression. Justice demands that anyone who abuses the legal process should be held accountable to deter similar actions in the future.”
The Hailakandi police commented on the judgment, saying, “This ruling sends a clear message to those who try to settle personal vendettas by making false allegations and misusing the police and judicial system. It serves as a strong warning to anyone who files false FIRs, wasting the already stretched resources of the criminal justice system for personal motives.”
This judgment underscores the serious consequences of filing false allegations and the importance of maintaining integrity within the legal system.
