Madhya Pradesh High Court Orders Probe Into False Rape Case Allegation

The Madhya Pradesh High Court has ordered an inquiry into a woman who allegedly filed a false rape case. The court directed the Superintendent of Police (S.P.) of Sehore district to conduct a thorough investigation into the matter.

Justice Sanjay Dwivedi, who presided over the case, remarked that such misuse of legal provisions must be addressed, emphasizing that the complainant should be taught a lesson for filing false accusations.

The High Court made these observations while hearing a pre-arrest bail plea filed by the accused. Initially, the woman accused the applicant of rape but later changed her statement in her statements under Sections 161 and 164 of the Criminal Procedure Code (CrPC).

When the accused applied for pre-arrest bail, the complainant told the lower court she had no objection to granting bail. She later admitted that the accused did not rape her and that she had made the allegations because the police had pressured her into doing so.

The court further clarified that if a non-bailable offense is identified against the complainant for her false allegations, the police should take appropriate legal action.
