Divorce Without Alimony Due to Wife’s Refusal to Follow Court Orders
In a recent divorce case from Pune, a man was granted a divorce from his wife without having to pay alimony, as she failed to follow the court’s orders. The couple married in 2009, and their relationship began to deteriorate shortly after.
According to the husband’s petition, his wife left him four months after their marriage, but occasionally returned for a few days. This pattern continued for about four years, after which she permanently left in 2013.
The husband tried to resolve the situation by issuing a notice to his wife in 2015, but she did not respond. Eventually, with the help of his lawyers, Adv. Shivajirao Deshmukh and Adv. Sai Deshmukh, the husband filed a petition in court.
The court initially ordered the wife to return and resume married life with her husband. However, she ignored the court’s order. In June 2018, the court gave her one more month to comply, but she still failed to appear.
By January 18, 2020, after multiple court hearings and delays caused by the COVID-19 pandemic, the husband filed for divorce. Despite restrictions and the pandemic, the court granted the divorce once the courts reopened, ruling that the wife’s failure to obey court orders justified the divorce without any financial support for her.
This case highlights the importance of adhering to court orders in divorce cases, as failure to comply can result in consequences such as the denial of alimony.
