Grandson’s Custody Battle After Tragic Death of Atul Subhash
The heartbreaking story of Atul Subhash, an automobile professional in Bengaluru, has taken another tragic turn. After his alleged suicide on December 9, his father, Pawan Modi, has filed an FIR in Bihar’s Samastipur district seeking custody of Atul’s 2-year-old son.
Filing the FIR
Pawan Modi lodged the complaint at the Vaini police station, blaming Atul’s wife, Nikita Singhania, and her family for his son’s death. The district police registered a zero FIR and forwarded it to Jaunpur, Uttar Pradesh, as the case falls under their jurisdiction.
A Plea for Justice
Expressing his anguish, Pawan Modi shared his deep concern for his grandson’s safety. “I have only seen my grandson once through a video call. I fear for his well-being and want him in my custody,” he said.
According to Pawan, the child’s whereabouts remain unknown, especially since Atul’s wife, her mother, and her brother are currently in custody. He emphasized that a 2-year-old child is not usually kept in a boarding school, raising fears about his safety.
Legal Struggles and a Family’s Resolve
Atul’s younger brother, Vikas Modi, is actively pursuing legal remedies. He called for stricter laws against the misuse of legal provisions, such as those related to dowry harassment. “We need changes in the legal system to prevent such tragedies,” he appealed.
The Supreme Court has taken notice of the case and issued directives to the police of three states, including Uttar Pradesh, to recover the missing child. A report is expected by January 7.
Atul Subhash’s Last Words
Before his death, Atul recorded a 90-minute video and wrote a 40-page note describing the harassment he faced from his wife and her family. He alleged that a demand for ₹3 crore as part of a divorce settlement pushed him to the brink.
In his suicide note titled “Justice is Due,” Atul addressed his child, saying, “I hope they don’t harm your soul. Always remember, you owe nothing to anyone.” He requested the legal system to grant custody of his son to his parents and demanded severe punishment for his harassers.
Atul also criticized the legal system, highlighting its misuse and calling for live hearings to raise awareness about his case.
A Fight for Justice
This tragedy has sparked debates on the misuse of legal provisions and the emotional toll such cases take on families. While Atul’s family seeks justice, they also hope to raise awareness about the challenges faced by victims of legal harassment.
Conclusion
The custody battle for Atul Subhash’s son is a painful reminder of the emotional and legal challenges families endure after such tragedies. As the investigation unfolds, his family remains determined to fight for justice and ensure the safety of their grandson.
