Santhosh, a BTech student in Chennai, was falsely accused of raping his neighbor. The accusation arose when the woman’s mother claimed he had impregnated her daughter and demanded marriage. When Santhosh denied the allegations, the woman and her parents filed a police complaint.
Santhosh was arrested and spent 95 days in custody before being granted bail on February 12, 2010. During this time, the woman gave birth to a child. However, a DNA test proved that Santhosh was not the father.
The case went to trial, and on February 10, 2016, a Chennai mahila court acquitted Santhosh of all charges.
Compensation for False Allegation
After his acquittal, Santhosh filed a suit seeking ₹30 lakh in damages, citing the financial and emotional toll of the false accusation. He revealed that he spent ₹2 lakh on legal expenses, lost educational opportunities, and could not secure a commercial driving license. Instead, he was forced to take a low-paying job as an office assistant.
The court partially granted his plea and ordered ₹15 lakh compensation. The woman and her parents, who filed the false complaint, were directed to pay the amount.
Lawyer’s Statement
Santhosh’s lawyer, A. Sirajudeen, explained that the incident began when Santhosh’s family moved to another neighborhood, distancing themselves from the woman’s family. Despite his denial of any relationship with her, the woman and her parents pursued false allegations that caused severe harm to Santhosh’s reputation and future.
