The High Court has granted anticipatory bail to a husband facing accusations of dowry harassment under Section 498A and the Dowry Prohibition Act. The case involves a complaint filed by the wife in December 2021, alleging that during their 2017 marriage, the husband’s family demanded a gold coin for each family member. When this demand was not met, the wife claimed she was subjected to harassment.
The FIR was registered against the husband based on these allegations. The husband, however, has made counter-allegations against his wife.
After reviewing submissions from both parties, the court concluded that the husband’s immediate custody would not resolve the issue. Single-judge Justice SV Kotwal, who granted the anticipatory bail, commented that the nature of marriages often leads to conflict, stating, “Marriages are not made in heaven, they are made in hell.”
Justice Kotwal ordered that if the husband is arrested, the police must release him on bail upon the submission of a bail bond of Rs. 30,000 with one or more sureties.
