Allahabad HC Grants Father Visitation Rights to Meet His Son

Allahabad HC Grants Father Visitation Rights to Meet His Son

Recently, the Allahabad High Court approved a Habeas Corpus petition filed by a father, Abhinay Jain, seeking visitation rights to meet his son, who currently resides with his mother, Megha Jain.

The child lives with his mother based on a mutual agreement reached during the couple’s divorce proceedings. Despite this agreement, Abhinay Jain claimed he was not allowed to meet his son and filed a complaint with the court.

Justice Anil Kumar Ojha, presiding over the case, stated that since the child was born from the marriage of Abhinay Jain and Megha Jain, the father is entitled to visitation rights.

Given the circumstances, the court granted the father the following visitation rights:

  1. Monthly Visits: The father can visit his son once a month, on the first Sunday, from 11:00 a.m. to 1:00 p.m. at the mother’s residence.
  2. Festive Visits: The father is allowed to meet his son for two hours on the day before Holi and Diwali at the mother’s residence.
  3. Peaceful Visits: Both parents are instructed not to cause any disturbance during these visits at the mother’s residence.

This ruling highlights the importance of maintaining a relationship between the child and both parents, even after a divorce.
