Air India Urination Case: Woman Urinated on Herself Due to Incontinence, Claims Shankar Mishra’s Lawyer

Shankar Mishra, arrested by Delhi Police on January 7, allegedly urinated on a woman in the business class of an Air India flight from New York to Delhi on November 26 last year. Mishra, reportedly inebriated, was subsequently banned from the airline for 30 days.

Legal Proceedings and Allegations

Delhi Police filed an FIR against Mishra on January 4, based on the woman’s complaint to Air India. Mishra faces charges under IPC sections 294 (obscene act in public place), 354 (assault or criminal force with intent to outrage modesty), 509 (insult to modesty), and 510 (misconduct in public by a drunken person), along with Aircraft Rules violations.

Defense Argument

On January 13, Mishra’s lawyer argued in a Delhi court that the complainant urinated on herself due to incontinence. The lawyer asserted that it was impossible for Mishra to reach the complainant’s seat as it was blocked.

“The woman has a problem of incontinence. She urinated on herself. She is a Kathak dancer, and 80% of Kathak dancers have this issue,” the lawyer claimed.

Court’s Response

The court dismissed the argument that Mishra couldn’t reach the woman’s seat, stating that it’s feasible to move from one side of the flight to the other. The judge requested a diagram of the flight’s seating arrangement for clarity.
