Chhattisgarh HC: Wife’s False Allegations Against Husband’s Mother Is Mental Cruelty

The Chhattisgarh High Court has ruled that a wife’s repeated false allegations of her husband having an illicit relationship with his mother amount to mental cruelty. This ruling recognizes the sacredness of the mother-son relationship and overturns a previous family court decision denying the husband’s divorce petition.

The bench, comprising Justice Goutam Bhaduri and Justice Sanjay S. Agrawal, allowed the appeal filed by the husband. The couple, married in May 2011, faced severe marital discord as the husband claimed his wife was hostile, frequently abusing him and his mother. Seeking a divorce, the husband initially faced a denial from the family court.

Upon reviewing the evidence, the High Court found that the wife had left her husband in December 2013 and filed a false complaint against him and his relatives under Section 498-A. The court acquitted all accused due to a lack of evidence. Additionally, the wife admitted in court to accusing her husband of having an illicit relationship with his mother.

Recognizing the wife’s entitlement to maintenance, the court determined that a monthly amount of ₹35,000 would be deducted from the husband’s salary at the source.

This ruling highlights the significance of maintaining respect for sacred family relationships and addresses the mental cruelty inflicted by by false accusations.
