Supreme Court Removes ₹9 Lakh Bail Condition Set by Jharkhand High Court
The Supreme Court has set aside a condition imposed by the Jharkhand High Court that required a husband to pay ₹9 lakh to his estranged wife as interim compensation in a domestic cruelty case under Section 498A of the Indian Penal Code (IPC).
This decision came while hearing appeals filed by the husband, Rohit Jaiswal, against the High Court’s April 2023 order. The Jharkhand High Court had allowed anticipatory bail but directed the husband to deposit ₹9 lakh as compensation to the wife.
A Supreme Court bench of Justices Sanjiv Khanna and SVN Bhatti ruled that the High Court was wrong in imposing this financial condition as part of bail.
“We believe that the High Court was not right in asking Rohit Jaiswal to pay ₹9 lakh as interim compensation. This condition is removed,” the Supreme Court said in its order dated September 27. However, the Court clarified that it did not interfere with the bail itself or the other conditions.
The Supreme Court also noted that the husband had voluntarily agreed to increase the monthly maintenance amount for his wife from ₹4,000 to ₹10,000. This decision came after the Court suggested a revision of the amount.
The bench stated, “The appellant, Rohit Jaiswal, will continue paying ₹10,000 per month as maintenance. If he fails to do so, the wife can take legal steps through the trial court.”
The Court also made it clear that the maintenance amount may be changed—either increased or decreased—by the trial or appellate court depending on future developments.
