Karnataka High Court Grants Divorce After Wife Insults Husband Over Dark Skin
The Karnataka High Court recently ruled that insulting a husband for his dark complexion, leaving him because of it, and making false accusations against him amounts to mental cruelty. As a result, the court granted divorce to the husband.
A division bench of Justice Alok Aradhe and Justice Anant Ramanath Hegde allowed the husband’s appeal and overturned the family court’s earlier decision denying the divorce.
The couple had married in 2007 and have a daughter. In 2012, the husband approached the family court in Bengaluru seeking divorce, claiming that his wife often humiliated him for his dark skin and falsely accused him and his family under Section 498A of the IPC in 2011. He also said she left him and moved in with her parents.
In response, the wife denied the accusations and alleged that her husband had an illicit relationship with another woman and physically abused her. However, the High Court noted that there was no valid evidence to support the wife’s claim of infidelity. The court also found no proof that the husband had a child with another woman, as the birth certificate did not name him as the father.
The court said the family court failed to recognize the impact of the wife’s false and serious accusations on the husband’s reputation.
During cross-examination, the wife said she was willing to return to her husband but refused to withdraw her complaints, showing that the relationship could not be repaired.
The bench concluded that the wife’s actions, including refusing to withdraw false complaints and insulting the husband, showed clear signs of cruelty. As a result, the court granted the husband divorce.
