In 2018, a false rape accusation by a woman in Mumbai led to her brother’s arrest. The brother, who spent two years in jail, was finally released in August 2021 after a special court in Dindoshi cleared him of all charges. The accusation stemmed from an incident where the girl’s brother scolded and confronted her for meeting her boyfriend.
The court’s ruling not only acquitted the 24-year-old man of rape but also dismissed charges under the Protection of Children from Sexual Offences (POCSO) Act. The girl had claimed that her brother raped her while their parents were away and filed an FIR against him.
During the trial, the court reviewed testimonies from both the complainant and the case’s investigating officer. The girl eventually admitted that she had fabricated the rape complaint because her brother had reprimanded her for seeing her boyfriend. The court noted inconsistencies and gaps in her testimony, which contributed to the dismissal of the charges.
