The Madhya Pradesh High Court has ordered an investigation into a false rape complaint filed by a woman. Justice Sanjay Dwivedi directed the Superintendent of Police (S.P.) in Sehore district to carry out a thorough inquiry into the matter.
The court’s decision came while reviewing a pre-arrest bail request from the accused. Initially, the complainant alleged that the appellant had raped her. However, her statement changed in subsequent filings under Sections 161 and 164 of the CrPC.
When the accused sought bail, the complainant indicated she had no objections to granting bail. Eventually, she admitted that no rape had occurred and that her allegations were made under pressure from the police.
Justice Dwivedi emphasized that such misuse of legal provisions needs to be addressed, and the court must hold individuals accountable for filing false complaints. The Bench further clarified that if the investigation reveals a non-bailable offense, the police should act according to the law.
