Father Wrongly Accused: Acquitted After 3 Years in False Rape Charges Case

In a distressing case from February 2021, a father endured more than three years of imprisonment after being falsely accused of rape by his niece. The incident began when an FIR was filed by the girl’s uncle at Modinagar police station, leading to the father’s arrest under various sections of the IPC and the POCSO Act.

The legal proceedings unfolded in the court of special judge (POCSO Act) Mahendra Srivastava, where it was revealed that the girl had been persuaded by her maternal uncle to falsely implicate her father. During the trial, the girl confessed to framing her father under her uncle’s influence.

Based on this revelation, the court acquitted the man who had suffered incarceration since the filing of the FIR. Additionally, Judge Srivastava imposed a fine of Rs 50,000 on the uncle for instigating the false rape allegations.

Subsequently, on 12th February, a special court in Ghaziabad sentenced the uncle to one-month simple imprisonment and further fined him Rs 50,000 for his role in manipulating the legal process. The court also directed that 50% of the fine amount be given to the father as compensation.

This case underscores the importance of thorough investigation and the severe consequences of false accusations under the law.
