“Women Shouldn’t Have to Choose Between Career and Child”: Bombay High Court Allows Mother to Relocate to Poland
The Bombay High Court has ruled that women should not be forced to choose between their careers and their children. In a significant judgment, the court allowed a mother to relocate to Poland with her daughter after securing a job there.
Justice Bharati Dangre set aside a lower court’s order that restricted the woman from traveling abroad, highlighting the importance of a woman’s right to professional growth. The court emphasized that career advancement should not come at the cost of parental responsibilities.
The woman had earlier filed a petition in a Pune family court under the Guardian and Wards Act to be declared the sole guardian of her daughter. Alongside this, she sought permission to travel to Poland with her child to pursue a job opportunity. She also requested that her husband submit a non-objection to facilitate the daughter’s visa process.
However, the family court denied her applications, barring her from leaving the country until the guardianship case was resolved. The woman challenged this decision in the High Court.
Justice Dangre overturned the family court’s decision, acknowledging the mother’s right to career progression while ensuring that the father’s parental rights were respected.
“The absence of the child from the country can be balanced by granting the father overnight access during her three vacations each year,” the court stated. It modified the visitation terms to prioritize quality time between the father and daughter over the quantity of time spent together.
This ruling highlights the court’s commitment to balancing parental rights while recognizing the importance of professional development for women.
