The Madras High Court has urged an estranged wife to treat her husband with empathy and hospitality during his visits to their child. Referring to the Indian philosophy of “Atithi Devo Bhava” (Guest is God), the court emphasized the need for kindness and understanding in co-parenting situations.
Case Background
The court was hearing a petition filed by the father of a 10-year-old girl, seeking joint custody and shared parenting. Since the divorced couple lives in separate towers within the same upscale housing community in Chennai, the court granted the father visitation rights on Fridays and Saturdays from 6 to 8 p.m.
Importance of Positive Co-Parenting
Justice Krishnan Ramasamy highlighted that turning a child against the other parent is a form of child abuse. He explained that hatred is a learned behavior, and every child has a fundamental right to a loving relationship with both parents.
“Children do not naturally feel hatred; rather, it is a taught emotion. Poisoning a child’s mind against their other parent is deeply harmful,” the judge stated.
Directions for Hospitality and Empathy
The court acknowledged that estranged spouses may not be expected to show affection to one another, but basic humanity demands they demonstrate kindness in their child’s presence. Justice Ramasamy expressed concern over cases where one parent mistreats the other during court-ordered visitations, creating a toxic environment for the child.
To address this, the court issued specific instructions to the mother:
- Welcome the visiting parent with hospitality.
- Offer snacks or dinner.
- Create a positive atmosphere to ensure the child feels happy and comfortable.
