Hiding Job and Income Details in Maintenance Plea Is Wrong, Says Punjab and Haryana High Court

Punjab and Haryana High Court: Woman Hiding Income in Maintenance Case Misused Legal Process

The Punjab and Haryana High Court has said that people should not make false claims while seeking help from the court. The observation came during a case where a woman hid her job and salary details while asking for maintenance under Section 125 of the Criminal Procedure Code (CrPC).

The woman, Ritu, had challenged an order from the Family Court in Ambala, which asked for an inquiry against her under Section 191 of the Indian Penal Code (IPC). This section deals with giving false evidence, which is punishable under Section 193 IPC.

Ritu had told the court she had no income when she applied for maintenance on July 26, 2017. But records showed that she had already started working as an Assistant Professor on July 3, 2017, with a monthly salary of ₹28,000. She repeated her false claim even during her court statement until she was shown proof of her employment.

The Family Court concluded that Ritu knowingly hid her income, and this act was serious enough to order a legal inquiry under criminal law for giving false evidence.

The High Court stated that maintenance under Section 125 CrPC is meant for people who truly cannot support themselves or their children. So, it is very important that anyone asking for maintenance must truthfully share their financial condition.

The court emphasized that making false claims misuses the court system and harms the purpose of justice. It said such actions must be strongly discouraged.
