Wife Has Right to Live in Comfort Based on Husband’s Status: Indore Court
A Sessions Court in Indore has ruled that a wife has the legal right to live and enjoy life according to her husband’s financial position. The court said that economic domestic violence includes not providing a wife with basic needs like food, clothing, and household expenses—especially if she lives separately from her husband.
Court Orders Compensation and Monthly Support
In this case, the husband, Mahendra (a builder and engineer), has been directed to pay ₹25 lakh in one-time compensation and ₹15,000 per month as maintenance to his wife.
The wife had earlier filed a maintenance claim in a district court after the couple separated due to ongoing disagreements. In 2008, the district court had ordered Mahendra to pay her ₹5,000 per month. However, the wife challenged this amount in the Sessions Court through her lawyer, Advocate KP Maheshwari.
Court Dismisses Husband’s Argument
Mahendra argued that his wife was capable of earning and therefore not entitled to maintenance. But the court rejected this claim, stating that even if she can work, he must still take care of her basic needs, especially when he has the financial means to do so.
Court’s Observation
The court said:
“Mental, physical, and financial abuse falls under domestic violence. Not providing food, clothing, or basic care is considered economic violence. In this case, the husband has failed to support his wife financially beyond what the court ordered earlier, despite having enough money to do so.”
However, the court did not grant the wife’s request for ₹51 lakh in damages for property loss and harassment due to a lack of strong evidence. Their daughter also testified that her father is supporting the children’s education and daily needs.
