Gujarat High Court Orders Wife to Pay ₹10,000 to Husband for Desertion Over Caste Differences
The Gujarat High Court recently ordered a woman to pay ₹10,000 to her husband after she deserted him because of differences in their sub-castes, despite both being from the Patel community.
The husband filed a Habeas Corpus plea in the High Court, claiming that his wife was being held illegally by her parents. He requested her production before the court.
On April 27, the wife appeared in court and acknowledged her marriage but stated that, despite both being from the Patel community, their different sub-castes made it impossible for her to continue the marriage. She had left her husband after four years of marriage.
The court expressed disappointment, noting how the caste and sub-caste system has negatively impacted the lives of young couples. It criticized the unreasonable basis for the wife’s desertion and awarded ₹10,000 in costs to be paid by her within four weeks.
In previous orders, the court also condemned the elders who influence young people’s lives in such a manner, calling it unfortunate that they perpetuate these issues.
The petition was disposed of with this ruling.
