The Karnataka High Court has ruled that a woman cannot be held responsible for her husband’s suicide simply because she was in a relationship with another man. The Court overturned the earlier conviction of the woman and her partner, saying there wasn’t enough evidence to prove they encouraged the man to take his own life.
Justice Shivashankar Amarannavar said that while the husband may have been upset about his wife’s affair, this alone does not prove that she or her partner pushed him to commit suicide. The judge also pointed out that a few days before the incident, the accused had told the husband to “go die,” but those words by themselves do not count as abetment under Section 306 of the Indian Penal Code.
The Court explained that to prove abetment of suicide, there must be clear evidence that the accused wanted the person to end their life. In this case, the court found no such intent. The man may have been emotionally sensitive due to his wife’s affair, but that is not a legal reason to hold her or her partner guilty.
As a result, the High Court cancelled the earlier ruling by the trial court that had convicted the woman, Prema, and her partner, Basavalinge Gowda. Both have now been acquitted of all charges.
