J&K Court Fines Wife ₹10 Lakh for Misusing Domestic Violence Law Against Husband
In a significant ruling, a Jammu and Kashmir court has ordered a woman to pay ₹10 lakh as compensation to her husband for misusing the Protection of Women from Domestic Violence Act. The court stated that the woman had abused the legal process to harass her husband and take away his right to live in his own house.
Wife Tried to Withdraw Case After Misusing Law
The woman had filed a complaint under the Domestic Violence (DV) Act, which she later tried to withdraw. However, her husband opposed the withdrawal, claiming that the petition was false and caused him serious harm, including being forced out of his home.
The court noted that this case was a clear example of how the law was misused, as the woman dragged the case all the way to the Supreme Court, despite having no valid grounds. She allegedly did this just to deprive her husband of shelter in his own property.
Court’s Strong Words on Legal Misuse
The judge said:
“The DV Act was created to protect women from real abuse, not to harass the husband or ruin peaceful marriages. Misusing this law for revenge or personal gain can harm real victims and damage the purpose of the law.”
Penalty and Orders by the Court
The court dismissed the woman’s petition and ordered her to:
- Pay ₹10 lakh to her husband as compensation.
- Restore his possession of the shared household, as it was before the case was filed.
- Pay the amount within one month. If not, it will be recovered as per land revenue laws.
Court’s Final Warning
The court emphasized that such misuse weakens the law and hurts genuine victims. Legal protections must be used with honesty and not as tools for personal vengeance.
