In a rare case from Gujarat, a woman who has been living in the United States for the past 10 years is refusing to consent to a divorce from her husband, focusing solely on obtaining maintenance. The couple’s 10-year-old son currently resides with his maternal grandmother due to the ongoing marital dispute.
The woman, who is avoiding her marital responsibilities, has given her brother power of attorney to fight her maintenance case in India. The Gujarat High Court observed that she seems more interested in demanding maintenance than resolving the marriage.
Expressing concern over the welfare of the couple’s young son, the High Court suggested that the woman return to India and consider a one-time settlement to end the marriage for the child’s sake. However, her brother informed the court that she has been living illegally in the US for the last decade. Despite her husband’s requests for her to return, she has refused, and she is also unwilling to agree to a divorce.
The court criticized the woman’s behavior as unreasonable, noting that she has approached the court primarily to push her husband into paying maintenance. The husband also revealed that his estranged wife is neither willing to take their son to the US nor give him custody.
In response, the High Court remarked that if this situation continues, the child’s custody might be transferred to the father.
