UP Assembly Approves Bill to Deny Anticipatory Bail to Rape Accused
The Uttar Pradesh Assembly has approved the Code of Criminal Procedure (UP Amendment) Bill, 2022, which prohibits granting anticipatory bail to individuals accused of rape and offences under the Protection of Children from Sexual Offences (POCSO) Act. This amendment modifies Section 438 of the CrPC, 1973, for cases in Uttar Pradesh.
Details of the Bill
The bill, presented by UP Parliamentary Affairs Minister Suresh Kumar Khanna, aims to strengthen protections for women and children. It specifically targets offences involving sexual misconduct (durachaar) and violations under the POCSO Act.
Minister Khanna emphasized that denying anticipatory bail in such cases will reduce the likelihood of the accused tampering with evidence or influencing victims and witnesses.
Government’s Stance
The government highlighted its zero-tolerance policy toward crimes against women and children in a formal statement. It stated:
- The amendment ensures prompt collection and protection of biological evidence in sexual offence cases.
- It minimizes the possibility of evidence destruction.
- It aims to safeguard victims and witnesses from intimidation or coercion by the accused.
By passing this bill, the state aims to bolster its legal framework to address crimes against vulnerable groups and ensure justice.
