The Supreme Court has granted legal protection to Paras, a man accused of rape and blackmail by his ex-wife. Paras, 29, fell in love with a Muslim woman and converted to Islam to marry her in April 2019. Despite allegations about her involvement in sex work, the couple married and sought protection from the Rajasthan High Court due to threats from her parents, which was granted in May 2019.
However, their relationship took a negative turn when the woman divorced Paras in July 2019 and filed an FIR in April 2023. She accused Paras of trying to force her into prostitution, raping her, and blackmailing her with explicit photos.
Paras, seeking relief, appealed to various courts before achieving success in the Supreme Court. The court ordered that he not be arrested immediately and issued a notice regarding his plea for anticipatory bail.
Paras’s plea highlighted the significant delay of four years in filing the FIR, suggesting that the complaint was intended to harass him and extort money. The plea argued that the FIR’s contents revealed an admission of marriage and conversion solely for the purpose of marriage.
Paras’s lawyer contended that the woman sought protection from her family through the Rajasthan High Court during the period the alleged incidents occurred. He claimed the woman continued her sex work even after their marriage, which led to their separation. The lawyer argued that the allegations were false and aimed at extortion.
The plea also noted that the High Court did not properly address the fact that the FIR accused Paras of dragging the woman into prostitution without fulfilling the necessary legal requirements. No evidence or witnesses had been presented to support the claim, and the allegations were deemed unsubstantiated by the court.
