A rape accused has approached the Kerala High Court to protect his right to privacy and dignity until his trial concludes. He is seeking orders to remove articles about him from The New Indian Express and Indian Kanoon, including bail orders that have been published online.
The petitioner argues that even those accused of a crime have a right to dignity and privacy under Articles 14, 19, and 21 of the Constitution of India. He claims that media coverage often disregards the principle of “innocent until proven guilty” and harms the accused’s right to a fair trial.
The petitioner is accused under Sections 376(2)(1) and 376(2)(n) and was released on bail after spending over a month in judicial custody. He is concerned about the negative impact of media coverage on his privacy and that of his family, especially since his full name and address were published online. This has affected his professional life, forcing him to step down from roles in his companies.
The plea emphasizes the rapid and uncontrolled spread of information and misinformation in the digital age. The petitioner seeks protection of his dignity, reputation, and privacy until the trial is over.
The petitioner is represented by advocates Geo Paul, Prem Kammath, CR Pramod, Radhika Rajasekharan, S Ashok Kumar, Simi V, Jacob George Pallath, Naveen TU, and Anil K Vincent.
