Mother Teaching Daughter to Speak Against Father is Cruelty: Madhya Pradesh High Court

The Madhya Pradesh High Court recently ruled that a mother coaching her daughter to speak against her father amounts to mental cruelty toward the father. This significant judgment was delivered while granting a divorce to a man who had faced several criminal cases filed by his wife, along with restrictions on seeing his minor daughter.

The division bench of Justice Sheel Nagu and Justice Vinay Saraf granted the divorce after finding that the wife had gone to extreme lengths to alienate the father from their daughter. The court noted that while it would not comment on the pending criminal cases filed by the wife, it found that the wife had crossed all limits in making accusations against her husband and his family.

The couple had a daughter in 2014, and the father was initially prevented from meeting her, which led him to file a civil case for custody. Despite the family court’s ruling allowing the father to meet his child, the mother repeatedly refused to comply.

The High Court, citing similar rulings from the Delhi and Kerala High Courts, emphasized that manipulating a child to turn against a parent constitutes mental cruelty. In this case, the wife had not only obstructed the father’s access to his daughter but had also coached the child to speak negatively about him.

The father had filed for divorce on grounds of mental cruelty and desertion. The case was transferred to the Family Court in Jabalpur, which initially dismissed the petition in 2020. This dismissal led to the current appeal in the High Court, which ultimately ruled in favor of the husband.

The High Court observed that the wife had caused significant mental distress to the husband by leaving their marital home shortly after their marriage and never returning. Multiple attempts at mediation failed, and both parties filed numerous cases against each other.

The court concluded that the marriage had irretrievably broken down due to the repeated legal disputes and that divorce would free both parties from the ongoing conflict. While the criminal cases were still pending, the court refrained from commenting on them, stating that such comments could impact the fair resolution of those cases.

The court’s ruling highlights the serious consequences of parental alienation, where one parent attempts to turn a child against the other, and how such actions can be deemed cruel and harmful.
