Matrimonial Case Can Be Quashed If Husband and Wife Settle Dispute: Allahabad High Court
The Allahabad High Court has stated that if a husband and wife have resolved their matrimonial issues through a mutual compromise, then the criminal case between them should be closed.
Justice Chandra Kumar Rai made this observation while cancelling criminal proceedings based on a police complaint filed by the wife against her husband and his family. The complaint included serious charges under Section 498-A (cruelty), Section 323 (assault) of the Indian Penal Code (IPC), and Sections 3 and 4 of the Dowry Prohibition Act.
The court’s decision came after it reviewed a compromise agreement made in March 2021. This agreement was signed by both the husband and wife and had been verified by a lower court. A verification report confirming the compromise was also sent to the High Court.
During the hearing, the husband and his relatives asked the court to cancel the criminal case. They explained that they had come to a peaceful agreement with the wife, and this compromise was legally verified.
It was also mentioned that the couple and their children were now living together happily. The court was convinced that continuing the case would serve no purpose.
As a result, the High Court decided to end the legal proceedings.
