Man Ignoring Rs 12,000 Maintenance Order Now Ordered to Pay Rs 2 Lakh/Month

A Surat-based couple’s legal battle over maintenance payments has taken a dramatic turn. In March 2017, the woman filed for maintenance in family court, stating that her husband had deserted her and their two children a year prior. She demanded Rs 3 lakh per month for herself and Rs 1 lakh per month for each child, claiming her husband, who is in the diamond business, earns Rs 25 lakh per month.

The husband denied these claims, stating he worked in diamond job work and was not as wealthy as his wife alleged. He expressed willingness to reconcile and had filed for the restitution of conjugal rights. In November 2019, the family court, without concrete proof of the husband’s income, estimated his earnings to be between Rs 40,000 and Rs 50,000 per month. The court ordered him to pay Rs 6,000 to his wife and Rs 3,000 to each child.

Despite the order, it was alleged that the husband failed to make any payments. The woman then approached the high court to increase the maintenance to her original demand, while the husband contested the maintenance order.

In February 2021, the high court ordered the man to pay Rs 3.25 lakh, citing his failure to comply with previous maintenance orders. However, on September 12, the woman’s advocate, Rajendra Jadhav, informed the court that the husband still had not paid any amount and had ignored the high court’s February 2021 directives. The lawyer also claimed that the husband used his influence to avoid court warrants and did not appear before the family court.

Justice Samir Dave expressed strong disapproval, stating, “This is not done.” He increased the monthly maintenance from Rs 12,000 to Rs 2 lakh. This adjustment raised the arrears from March 2017 to a staggering Rs 1.32 crore from the original Rs 7.92 lakh.

The court’s decision highlights the severe consequences of ignoring maintenance orders and underscores the importance of compliance with court directives.
