Madhya Pradesh High Court Orders Inquiry Against Woman for False Rape Allegation
The Madhya Pradesh High Court has ordered an enquiry into a woman’s complaint after she allegedly filed a false rape case against a man. The Court directed the Sehore district police to investigate the matter properly, stating that such actions misuse legal provisions.
Court’s Remarks on False Allegations
The bench, led by Justice Sanjay Dwivedi, emphasized that people misusing the law must be taught a lesson. The Court made these comments while considering a pre-arrest bail plea filed by the accused. Initially, the woman had accused the man of rape. However, her version changed later in her statements given under sections 161 and 164 of the Criminal Procedure Code (CrPC).
Woman Admits to Making False Allegations
The complainant eventually admitted that the man did not rape her. She stated that she had made the false allegation because the police had pressured her into doing so. Later, during the bail proceedings, the woman said she had no objection to granting bail to the accused.
Court’s Order
Justice Dwivedi clarified that if the police find that a non-bailable offense has been committed by the complainant, they should proceed according to the law. The Court also highlighted the importance of addressing cases where legal provisions are misused, especially in sensitive matters like rape.
