The Gauhati High Court recently convicted a lawyer for making derogatory remarks about a woman judge, comparing her to the mythical demon ‘Bhasmasur’. The lawyer, Utpal Goswami, criticized the judge’s appearance and demeaned her judicial competence.
A division bench consisting of Justice Kalyan Rai Surana and Justice Devashis Baruah presided over the suo motu case. They granted the lawyer bail on a personal bond of Rs 10,000.
The court charged Goswami with criminal contempt under Section 14 of the Contempt of Courts Act, 1971, for his disrespectful comments, including remarks about the judge’s jewelry and her conduct in court. In his defense, Goswami admitted guilt and submitted an apology, acknowledging that judges should be treated with respect to maintain peace, order, and harmony in society.
Lawyer’s Apology and Admission of Guilt
Goswami admitted in an affidavit filed on January 17 that his actions were due to insufficient knowledge of the law. He expressed deep regret for his behavior and promised the court that he would never repeat such conduct in the future.
The court’s order further highlighted that Goswami accused the judge of behaving like a “model on a ramp” by wearing jewelry and overpowering advocates with unnecessary legal citations.
Next Steps
The sentencing hearing was scheduled for March 20, 2023, but further updates on the sentencing are yet to be received.
