Kerala to Make Divorce Registration Compulsory for Welfare of Families
Kerala is preparing to become the first state in India to make it mandatory to register divorces. The state government is planning a new law to introduce a divorce registry to ensure the welfare of divorcees and their children.
Local Self Government Minister MV Govindan announced that the step is being taken based on recommendations from the Kerala Legislative Assembly Committee on the Welfare of Women, Children, Transgender, and Disabled Persons.
The divorce registry will record important details, including the names and details of children (if any) at the time of divorce. The goal is to ensure that children’s rights and future are protected during and after the divorce process.
This new legislation will be passed under the Kerala Marriage and Divorce Registration Act. The Kerala Marriage Registration Rules, 2008, will be amended to include rules for registering divorces.
Currently, no Indian state requires divorce registration by law, making Kerala the first to introduce such a policy. The Law Commission of India had already suggested this in its 2008 report, where it highlighted the need for registering both marriages and divorces for better record-keeping and legal clarity.
The Minister emphasized that marriage and divorce fall under the Concurrent List of the Indian Constitution, giving states the authority to make such laws.
This important step is expected to improve legal support for divorced individuals and their children, offering them more security and protection under the law.
