Karnataka High Court Orders Husband to Pay Rs 25,000 for Wife’s Litigation Expenses in Divorce Case
The Karnataka High Court recently directed a husband to pay Rs 25,000 to his wife to cover her litigation expenses. This amount will help her hire a lawyer and defend herself in the divorce case initiated by her husband.
The couple married on 26th December 2011 and have two children together. The husband filed for divorce under Sections 13(1)(i) and (ia) of the Hindu Marriage Act. In response, the wife applied under Section 24 of the Hindu Marriage Act, asking the court to order her husband to pay Rs 75,000 for legal fees.
The trial court rejected her request, saying she should seek help from the District Legal Service Authority. It also held that there was no rule that required the husband to pay her litigation costs.
Not satisfied, the wife appealed to the Karnataka High Court. She argued that her husband earns over Rs 80,000 per month as Head of Human Resources, while she has no income and is taking care of their two children. Given this, she said her husband should pay some litigation costs.
Justice S G Pandit reviewed the case and said the requested Rs 75,000 was too high. However, he agreed the husband should help and ordered him to pay Rs 25,000 towards her litigation expenses.
The court also urged both parties to cooperate with the trial court for a fast resolution of the divorce case. The trial court was instructed to handle the husband’s divorce petition quickly.
