Karnataka HC Quashes Dowry Case Against Man and His Bedridden Grandmother
In a major relief for Mohammed Shameer and his family, the Karnataka High Court has dismissed a criminal case related to dowry harassment, which also named his 80-year-old bedridden grandmother.
The case was based on a complaint filed by Shameer’s wife, Jasmine, from Chitradurga. She accused Shameer and his family of dowry harassment, assault, and other charges under the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, 1961. Besides Shameer and his grandmother, his parents, brother, sister-in-law, and a distant relative were also listed as accused.
Shameer and Jasmine were married on October 24, 2020, but soon began having marital issues. Jasmine returned to her parents’ home shortly after the wedding. In March 2021, Shameer filed a civil case to prevent Jasmine from interfering in his household matters. Three months later, he filed for divorce. Jasmine then filed a dowry and harassment complaint, also alleging an attempt to kill her.
The petitioners claimed that Jasmine’s complaint was made to counter the civil and divorce cases and was an abuse of legal process. They pointed out that even an elderly, bedridden woman was falsely accused without specific allegations.
Justice M. Nagaprasanna ruled in favor of the petitioners, stating that the entire family was dragged into the case without clear evidence. He noted that vague and baseless claims were made and no proof of physical assault or attempted murder was provided.
The court found that continuing the case would misuse the law. It ruled that except for one general allegation against the husband, there were no separate claims against other family members.
