The Madhya Pradesh High Court has emphasized that a husband and wife are expected to live together with a sense of mutual adjustment, which is vital for maintaining the marital bond. This observation was made by Justice Rohit Arya and Justice Milind Ramesh Phadke while hearing an appeal filed by a wife challenging a decree for Restitution of Conjugal Rights (RCR) awarded to her husband.
Background of the Case
The couple got married in April 2015 but started living separately just a month later, in May 2015. After three years of separation, in May 2018, the husband filed a petition under Section 9 of the Hindu Marriage Act, 1955, seeking restitution of conjugal rights in the First Additional District Court, Dabra, Gwalior.
The lower court, acknowledging the husband’s genuine intentions, granted the decree in his favor. The wife, however, challenged this decision in the High Court.
Reconciliation During Proceedings
During the High Court hearing, the wife expressed her willingness to reconcile and live with her husband, indicating that she no longer wished to pursue the appeal. The husband, in turn, assured the court that he would treat his wife with dignity, ensure her comfort, and provide a respectful living environment within his means.
Court’s Observations and Judgment
The High Court praised the husband’s gesture of willingness to reconcile and upheld the order passed by the lower court. The judges stressed that mutual adjustment and understanding are key elements for a successful marriage.
By upholding the decree, the court encouraged the couple to resolve their differences and live together harmoniously.
