Bombay High Court Grants Anticipatory Bail to Husband in Dowry Case, Says ‘Marriages Are Made in Hell’
The Bombay High Court has granted anticipatory bail to a man accused of cruelty and dowry harassment by his wife. The wife had filed a complaint in December 2021, claiming that during their marriage in 2017, her husband’s family demanded a gold coin for each family member. When the demand wasn’t fulfilled, she alleged that she was harassed.
Following her complaint, the police registered an FIR under Section 498A of the Indian Penal Code and the Dowry Prohibition Act. The husband denied the allegations and made counter-claims against his wife.
Justice SV Kotwal, who heard the case, said that keeping the husband in custody would not solve the marital problems. The judge noted that the couple had been constantly fighting and remarked during the hearing, “Marriages are not made in heaven, they are made in hell.”
Considering the ongoing conflict and lack of evidence that arrest would help, the court granted anticipatory bail. The judge ordered that if the husband is arrested, the police should release him on a bail bond of ₹30,000 along with one or more sureties.
This case highlights the complex nature of marital disputes and how courts weigh both sides before making decisions.
