Woman in Hailakandi Sent to Judicial Custody for False Rape FIR

On July 15, an Additional Session Judge in Hailakandi, Assam, ordered a woman to be held in judicial custody for filing a false rape complaint. The court also registered a case against her under Sections 193 and 195 of the Indian Penal Code (IPC) for providing false evidence and declarations.

The woman had originally filed an FIR accusing an individual of rape, leading to charges under Sections 448 and 376 of the IPC. However, it was later revealed that her allegations were untrue. The accused claimed that the woman had a personal vendetta related to a land dispute.

The court noted, “Rape is a serious crime, and when such cases are reported, society demands severe punishment for the perpetrators. False accusations not only harm innocent individuals but also undermine the judicial system.” The court emphasized that the legal system should not be misused for personal grievances.

In its ruling, the court stated, “The justice system must address those who abuse legal processes. This judgment serves as a strong warning against making false accusations and wasting the already limited resources of the criminal justice system for personal gain.”

The Hailakandi police added, “This judgment sends a clear message to anyone who tries to settle personal scores by making false claims and misusing the judicial system. It should deter others from similar acts.”
